Extending a residence permit or an X2 stay: when to apply
Unofficial summary · Sources checked
If your residence permit is about to expire, the Exit and Entry Administration Law says you apply within the 30 days before its validity ends (Law Article 32). If you hold an X2 visa and need more time in China, you apply seven days before the stay in your visa expires (Law Article 29). The two cases have different deadlines, and Law Articles 29 and 32 do not say what happens to an application filed after either deadline.
This is an unofficial summary. The X1 or X2 visa check shows which visa line applies to your study length and prints the steps after entry. It does not count the 30-day or seven-day periods, so work those out from your own expiry dates.
Two cases, two deadlines
| Case | When to apply | Where to apply | Rule source |
|---|---|---|---|
| Residence permit | Within the 30 days before the permit's validity expires | Exit/entry administration under the public security organ of a local government at or above county level | Law Article 32 |
| X2 stay | Seven days before the stay in the visa expires | Exit/entry administration in the place where you stay | Law Article 29 |
Keep these apart. A residence permit and a visa stay are different documents with different clocks.
Residence permit
Law Article 32 says a foreigner who wants to extend their stay files the application within 30 days before the residence permit's validity expires. The application goes to the exit/entry administration described above, with the information required for the specific application. If the reasons for extension are appropriate and sufficient, the extension is granted. If it is denied, the foreigner leaves China when the validity in the permit expires.
The National Immigration Administration's Chinese service guide for residence permits says, in section 六(三), that an applicant for extension of the duration of stay or a change to registered details submits the supporting certificates or personal information required under the clauses above, and may then have the stay extended or the permit replaced (换发). This is the Chinese-language version of the guide. The English rendering here is this site's translation of the Chinese text. The guide prints no date of its own, and section 六(三) does not itself list the documents for an extension; it refers back to the clauses above it. Ask the office handling your case which documents to bring.
The Law speaks of foreigners in general. It does not name students in Article 32.
X2 stay
Law Article 29 has three parts that matter here:
- A visa holder whose visa stay is 180 days or less may stay in China within the duration printed in the visa.
- If the stay needs to be extended, the holder applies seven days before the stay expires, to the exit/entry administration in the place of their stay. If the reasons are appropriate and sufficient, the extension is granted. If it is denied, the foreigner leaves China on the expiry date.
- The accumulated extension may not exceed the original duration of stay in the visa.
The Regulations on Administration of the Entry and Exit of Foreigners (State Council Decree No. 637), Article 14, add three points. An extension decision is valid only for the current entry. It does not change the number of entries or the validity of the entry in the visa. The total extension may not exceed the original stay, and the holder must keep to the purpose stated in the original visa and stay within the extended period.
The National Immigration Administration's English visa extension guide, dated 1 April 2021, says the same seven-day application period in its section 2. For an X2 holder, its document list (item j) asks for a current study certificate issued by an education or training institution in China. The same item says the stay may be extended for no more than 180 days. The guide also notes that the accumulated extension may not exceed the original duration in the visa. The 180-day figure is in the guide and is not a term of Law Article 29. Both wordings are shown here; the office handling your case decides which applies to your file.
Dates to check
- Find the expiry date printed on your residence permit.
- Count back 30 days from that date for the residence permit application window (Law Article 32).
- Find the stay end date in your visa.
- Count back seven days from that date for the X2 extension application (Law Article 29).
Law Articles 29 and 32 do not say how the days are counted or whether the first or last day is included, and neither says what happens to an application filed after the deadline.
What is and is not stated
- Law Articles 29 and 32 state no fee and no processing time. The English visa extension guide gives the validity of the acceptance receipt for visa applications (no more than seven working days from the date of acceptance, section VIII) and has a section on visa charging standards (section IX); the Chinese residence permit guide gives the validity of the acceptance receipt for residence permit applications (no more than 15 working days from the date of acceptance, section 八) and fees by validity band (section 九). Ask the office handling your case.
- Law Articles 29 and 32 do not say what happens to an application filed late.
- Section 六(三) of the Chinese residence permit guide does not say whether a residence permit extension needs the study certificate that the English visa guide lists for X2 holders.
The site does not accept or submit applications and is not affiliated with any ministry, embassy or university. A tool result is not a decision.
